AGF Fagbemi Clarifies Presidential Prerogative of Mercy Exercise: Says Process Still Under Review, Not Yet Final

The Attorney-General of the Federation and Minister of Justice, Prince Lateef Fagbemi (SAN), has clarified that no inmate approved for clemency under the recent exercise of the President’s prerogative of mercy has been released.

In a statement issued on Thursday, Fagbemi explained that the process remains at its final administrative stage, which involves a comprehensive review to ensure that all recommendations comply with legal and procedural standards before any instrument of release is issued.

According to him, “The last stage of the exercise, after approval by the Council of State, is the issuance of the instrument for the implementation of the decision concerning each beneficiary. This stage affords an opportunity for a final look at the list for remedial purposes, if any, before the instrument is forwarded to the Controller-General of Corrections for necessary action.”

The Attorney-General emphasized that the verification process is part of standard government protocol and reflects the administration’s commitment to transparency, accountability, and due diligence.

Fagbemi also acknowledged the public’s vigilance and constructive feedback on the matter, noting that such engagement underscores Nigerians’ passion for justice and good governance.

“There is no delay in the process; it is simply following the law to the letter to ensure that only those duly qualified benefit from the President’s mercy. The rule of law does not rush; it ensures fairness,” he stated.

He assured that once all legal and procedural checks are concluded, the public will be fully informed.
