Federal High Court Dismisses Three Suits Challenging Rivers State Emergency Rule

Justice James Omotosho of the Federal High Court in Abuja delivered three separate rulings dismissing lawsuits that contested President Bola Ahmed Tinubu’s proclamation of a state of emergency in Rivers State.
Justice Omotosho described the suits as “frivolous and baseless,” emphasizing that the plaintiffs—ordinary residents—did not demonstrate unique harm compared to elected officials or the general populace.
He affirmed that Tinubu invoked valid emergency powers without needing National Assembly ratification for the initial proclamation, and no evidence contradicted the need to avert chaos.
The judge also validated the emergency rule’s purpose in restoring peace, noting its successful conclusion
